This Personal Data Privacy Policy applies to all information that the Balkitten.me website
may obtain about the User while they use the website, its subdomains, programmes, and products.
By using Balkitten.me, you acknowledge that you have read, understood, and agree to the terms set out below.
The operator of this platform is Real Application DOO Bar, a company registered in Montenegro
(Company No. 03641163), with its registered office at
ul. Gavrila Principa 200, 85000, Bar, Montenegro.
We are committed to protecting your privacy and processing your personal data lawfully,
in accordance with the Law on Personal Data Protection of Montenegro and applicable
EU data protection standards (GDPR).
§ 01 Definition of Terms
The following terms are used throughout this Privacy Policy:
Site Administration
Authorised employees responsible for managing the Balkitten.me website, who organise and process
personal data and determine the purposes and methods of such processing.
Personal Data
Any information relating directly or indirectly to a specific or identifiable individual
(the subject of personal data).
Processing of Personal Data
Any action or set of actions performed with personal data — including collection, recording,
systematisation, storage, update, extraction, use, transfer, depersonalisation, blocking,
deletion, or destruction — whether using automated tools or otherwise.
Confidentiality of Personal Data
A mandatory obligation on the Administration or any person who has gained access to personal data
to prevent its dissemination without the consent of the data subject or other legal grounds.
Balkitten.me
A collection of interconnected web pages hosted on the Internet at
https://balkitten.me, including all its subdomains, operated by
Real Application DOO Bar.
User
Any person who accesses the Balkitten.me website via the Internet and uses information,
materials, or products available on the platform, regardless of whether they register an account.
Seller / Breeder
A registered User of the Balkitten.me platform who lists animals for sale through the Marketplace.
Buyer
A registered User who selects Pets on the platform and has the right to reserve or purchase them
through Balkitten.me.
IP Address
A unique network address assigned to a device in a computer network through which the User accesses
the website.
§ 02 General Provisions
2.1.
The use of the Balkitten.me website by the User constitutes acceptance of this Privacy Policy
and the terms governing the processing of the User's personal data.
2.2.
If the User disagrees with the terms of this Privacy Policy, they must discontinue use of the
Balkitten.me website.
2.3.
This Privacy Policy applies exclusively to Balkitten.me and does not govern third-party websites
to which Users may be directed via links on our platform.
We encourage Users to review the privacy policies of any external sites they visit.
2.4.
The Administration does not independently verify the accuracy of personal data provided by Buyers.
The Administration does, however, verify the authenticity of data submitted by registered Sellers (Breeders).
§ 03 Subject of the Privacy Policy
3.1.
This Privacy Policy establishes the obligations of the Administration with regard to the non-disclosure
and protection of personal data that the User provides at the request of the Administration when
registering on Balkitten.me or subscribing to our newsletter.
3.2.
Personal data permitted for processing under this Policy is provided voluntarily by the User through
registration forms on the website, or via social network login, and includes:
- full name;
- e-mail address;
- phone number;
- media files and other information submitted by the User.
3.3.
The Administration also protects data that is transmitted automatically when pages are visited,
including: IP address, cookie data, browser information, access time, and referrer URL.
3.4.
Any other personal information not listed above — such as browsing history, browser type, or
operating system — is subject to secure storage and is not shared with third parties.
§ 04 Purposes of Collecting Personal Data
The Administration may use Users' personal data for the following purposes:
4.1.
Establishing feedback with the User — including sending notifications, responding to enquiries,
and processing requests or complaints related to the use of Balkitten.me.
4.2.
Verifying the accuracy and completeness of personal data provided by the User.
4.3.
Notifying the User about their order or a Pet of interest, via e-mail or another agreed channel.
4.4.
Providing effective technical support in cases involving issues with the use of the platform.
§ 05 What Personal Data We Collect
5.1. Comments
When a visitor leaves a comment on the platform, the Administration collects the data entered
in the comment form, as well as the visitor's IP address and browser user agent string,
to assist with spam detection.
5.2. Contact Forms
Balkitten.me collects the following information from registered Users via contact forms:
- name;
- phone number;
- city and country of residence;
- e-mail address;
- contacts in instant messaging services.
5.3. Payment Data
When making a payment through Balkitten.me, the User does not submit bank card details directly
to our platform. All payment data is processed by an authorised third-party payment provider,
which operates under its own data protection system and privacy policy.
§ 06 Integrated Content from Other Sites
6.1.
Pages on Balkitten.me may include embedded content from external sources (for example, videos or images).
Such embedded content behaves in exactly the same way as if the visitor had navigated directly to the
originating website.
6.2.
These third-party sites may independently collect data about you, use cookies, implement additional
tracking technologies, and monitor your interactions with embedded content — including whether
you are logged into their platform.
Balkitten.me has no control over, and accepts no responsibility for, the data practices of such
external sites.
§ 07 Use of Personal Data
7.1. Sharing Data with Third Parties
7.1.1.
The Privacy Policy of Balkitten.me permits only limited transfer of User data to other platform
participants — specifically to the Sellers and Buyers involved in a transaction.
This transfer occurs prior to the conclusion of the agreement between the parties.
7.1.2.
The information transferred in such cases is limited to:
- name;
- registration address;
- profile photo (if provided).
Payment information is never transferred to third parties.
7.2. Data Storage
7.2.1.
If a User leaves a comment on the platform, the comment and its associated metadata are stored
indefinitely.
§ 08 Rights and Obligations of the Parties
8.1. The User has the right to:
8.1.1.
Freely decide whether to provide personal data required for using Balkitten.me and to consent
to its processing.
8.1.2.
Update or supplement their personal data at any time should that information change.
8.1.3.
Request an export file of personal data stored about them on the platform.
The User may also request the deletion of their data; however, this does not include data
the Administration is required to retain for administrative, legal, or security purposes.
In particular, transaction data relating to purchases made within the preceding year may be
retained as required by law.
8.1.4.
Demand from the Administration clarification, blocking, or destruction of their personal data
if it is found to be incomplete, outdated, inaccurate, unlawfully obtained, or no longer necessary
for the stated processing purpose.
8.2. The Administration is obliged to:
8.2.1.
Use the information received solely for the purposes specified in this Privacy Policy.
8.2.2.
Maintain the confidentiality of personal data and refrain from disclosing, selling, exchanging,
publishing, or otherwise sharing it without the prior written consent of the User.
8.2.3.
Apply appropriate precautions to protect the confidentiality of the User's personal data,
in accordance with standard industry practice for the protection of such information.
8.2.4.
Block personal data relating to the User upon receiving a request from the User, their legal
representative, or a competent data protection authority, for the duration of any verification
process in cases of alleged inaccuracy or unlawful processing.
8.2.5.
Bear responsibility for losses incurred by the User as a result of the misuse of personal data,
in accordance with applicable law, except in cases expressly provided for in this Privacy Policy.
The Administration shall not be liable where confidential information:
- entered the public domain before its loss or disclosure;
- was received from a third party prior to its receipt by the Administration;
- was disclosed with the explicit consent of the User;
- was disclosed pursuant to a court order.
§ 09 User Responsibility
9.1.
The User bears full responsibility for compliance with all applicable legal requirements,
including but not limited to legislation on advertising, copyright and related rights, and the
protection of trademarks and service marks — as well as full responsibility for the content and
form of any materials they post on the platform.
9.2.
The User acknowledges that responsibility for any information — including data files, texts, and
other content — to which they may gain access via Balkitten.me lies with the person who provided
such information.
9.3.
The User acknowledges that content available on the platform may constitute intellectual property,
the rights to which are reserved by other Users, partners, or advertisers.
The User is not entitled to modify, rent, lend, sell, distribute, or create derivative works based
on such content — in whole or in part — unless expressly authorised in writing by the rights holder.
9.4.
Redistribution of text materials from Balkitten.me is permitted provided that a clear and visible
link to the Balkitten.me website is included.
9.5.
The Administration accepts no responsibility for any direct or indirect losses arising from:
- use of, or inability to use, the platform or individual services;
- unauthorised access to the User's communications;
- statements or actions of any third party on the platform.
9.6.
The Administration accepts no responsibility for any content published by the User on
Balkitten.me, including but not limited to content protected by copyright published without the
express consent of the rights holder.
§ 10 Dispute Resolution
10.1.
Prior to initiating legal proceedings in connection with any dispute arising from the relationship
between the User and the Administration, it is mandatory to first submit a written claim
(a formal written or electronic proposal for voluntary dispute resolution).
10.2.
The recipient of such a claim shall, within 7 calendar days of receipt, notify
the claimant in writing or electronically of the outcome of the review.
10.3.
If the parties are unable to reach an amicable resolution, the matter may be referred to formal
dispute resolution in accordance with the laws of Montenegro.
10.4.
This Privacy Policy shall be governed by and construed in accordance with the laws of
Montenegro. Any disputes arising from or in connection with this Policy shall
be subject to the exclusive jurisdiction of the competent courts of Montenegro.
§ 11 Changes to This Policy
11.1.
The Administration reserves the right to amend this Privacy Policy at any time without requiring
the prior consent of Users. The updated Policy takes effect from the moment it is published on
the Balkitten.me website.
11.2.
Where changes materially affect Users' rights or obligations, the Administration will endeavour
to notify registered Users via e-mail or through their account dashboard.
11.3.
Continued use of Balkitten.me following the publication of an updated Privacy Policy constitutes
the User's acceptance of the revised terms.
